These Terms of Service (“Terms”) govern your access and use of our services, including our AI receptionist tools, chatbots, and related SaaS products (the “Services”). 1. Eligibility
Our Services are intended only for businesses. Individual consumer or personal use is not permitted.
You represent that you are authorized to enter into this agreement on behalf of your business.
You must comply with all applicable laws and regulations in your jurisdiction.
2. Services Provided
BlueAI provides AI-powered services, including but not limited to:
AI receptionists and virtual assistants
Chatbots and conversational AI for business use
Integrations with platforms such as Go High Level and OpenAI infrastructure
We may modify or improve the Services at any time.
3. Payment Terms
Subscriptions: Recurring fees billed monthly.
One-Off Payments: Certain Services may be purchased for a one-time fee.
Free Trial: We may offer free trials. After the trial, paid plans will apply.
Refund Policy: No refunds are provided, except where required by law.
Billing: By subscribing or purchasing, you authorize BlueAI to charge your chosen payment method on a recurring basis until cancellation.
4. User Responsibilities
By using our Services, you agree to:
Use the Services only for lawful business purposes.
Not use the Services to create, transmit, or promote harmful, abusive, defamatory, hateful, or illegal content.
Not use the Services for medical, legal, financial, or other regulated professional advice.
Not infringe on third-party intellectual property rights.
Not misuse the Services for activities such as spam, hacking, or automated scraping.
5. Company Rights
We may suspend or terminate accounts that violate these Terms or applicable laws.
We reserve the right to modify, limit, or discontinue Services at our discretion.
We may refuse service to any business for any lawful reason.
6. Intellectual Property
BlueAI’s IP: We retain ownership of our software, AI models, platform, branding, and all related intellectual property.
Client Content: Clients retain ownership of the data and content they provide.
AI Outputs: Clients are granted full ownership of AI-generated outputs for permitted business uses, subject to these Terms. BlueAI does not guarantee the accuracy, reliability, or legality of outputs.
7. Disclaimer of Warranties
Our Services and AI outputs are provided “as is” and “as available” without warranties of any kind.
We do not guarantee that AI outputs will be accurate, reliable, or suitable for any specific purpose.
AI-generated content may contain errors, biases, or inaccuracies. Clients are responsible for reviewing outputs before relying on them.
8. Limitation of Liability
To the maximum extent permitted by law, BlueAI will not be liable for indirect, incidental, consequential, or punitive damages.
Our total liability for any claim will not exceed the amount you paid to BlueAI for the Services in the 3 months preceding the claim.
9. Termination
By Client: You may cancel your subscription or account at any time.
By BlueAI: We may suspend or terminate your account at any time, including for violation of these Terms, non-payment, or other reasons at our discretion.
Upon termination, you must stop using the Services, but ownership of your client data/content remains with you.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of New Zealand.
Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
11. AI Usage Restrictions
Clients must not use AI outputs for:
Unlawful, harmful, discriminatory, or deceptive activities
Generating medical, legal, or financial advice
High-risk decision-making processes without human oversight
12. Changes to Terms
We may update these Terms at any time. The latest version will be posted on our website with the effective date. Continued use of our Services constitutes acceptance of the updated Terms.
